1. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and Apex Home Automations LLC, a Texas limited liability company that operates the Chorby application and related services (collectively, the "Service," "Chorby," "we," "us," or "our"). By accessing or using Chorby, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including parents, guardians, and children using the Service under parental supervision.
2. Description of Service
Chorby is a product of Apex Home Automations LLC. It is a private family task, routine, reward, and allowance app managed by parents and legal guardians. Adults create and manage the household; children use supervised family profiles rather than registering independent accounts. Chorby helps parents:
- Create and assign household tasks to children
- Track task completion with optional photo verification
- Manage a points/rewards system (gems) for completed tasks
- Track allowance earnings and history
- Engage children through gamification with Chorby mascot companions
Chorby is not a financial service. We do not transfer family allowance money or connect to bank accounts. Allowance tracking is for informational purposes only; app subscriptions are billed through the stores described in section 6.
3. User Eligibility
To create a parent/guardian account, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater. By creating an account, you represent that you meet this requirement.
Children Under 13
Chorby uses a parent-managed family account model:
- Children under 13 cannot create accounts independently
- A parent or legal guardian must create the family account
- When you add a child profile, you confirm that you are the child’s parent or legal guardian and acknowledge the collection and use described in our Privacy Policy
- You are responsible for supervising your child's use of the Service
4. Account Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and device
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
Keep your sign-in credentials private. You may allow children in your household to use the parent-managed Adventure Zone and family members to use your shared Chorby Hub as intended. Another parent or guardian should join your household using their own account through Join Existing Family, rather than your sign-in credentials. You remain responsible for authorizing household access, protecting parent controls, and supervising your children’s use.
5. Use of the App
You agree to use the Service in compliance with all applicable laws and regulations. You are responsible for maintaining the security of your device and account.
Permitted Uses
- Personal, non-commercial family task management
- Managing tasks for your own household
- Tracking allowances for children in your care
Prohibited Uses
You agree NOT to:
- Violate any laws or regulations
- Upload inappropriate, harmful, or offensive content
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service
- Reverse engineer or attempt to extract the source code
- Interfere with or disrupt the Service or other users' experience
- Use automated systems to scrape or access the Service
- Impersonate Chorby staff or other users
- Use the Service for commercial purposes without authorization
We may throttle, rate-limit, or otherwise restrict usage that degrades or abuses the Service, in addition to our suspension and termination rights under these Terms.
6. Subscriptions and In-App Purchases
Chorby is offered as a paid subscription, which may include a free trial when available. On iPhone and iPad, you purchase through the Apple App Store. On Android, you purchase through Google Play. Parent access to the Service requires an active subscription or trial entitlement. Current plan details are shown in the app and on the store listing you use, and we may modify them with notice.
Payment Processing
- Apple App Store purchases use Apple’s payment system. Android purchases use Google Play Billing.
- We do not directly collect or store your payment card details.
- Billing follows the account settings of the store you originally purchased from. Manage or cancel there, even if you now use Chorby on a different type of device.
- Prices may vary by region and are displayed in your local currency.
Subscription Terms
- Subscriptions automatically renew until you cancel them in the store you used to subscribe.
- Apple App Store: cancel at least 24 hours before the end of the current period to avoid the next charge. Manage or cancel in iOS Settings → your name → Subscriptions, or see Apple’s subscription guide.
- Google Play: you may cancel at any time before the end of the current period. Cancellation applies to the next period. Manage or cancel in the Google Play app (profile → Payments & subscriptions → Subscriptions), at play.google.com/store/account/subscriptions, or see Google Play’s subscription help.
- If you cancel, you keep access to premium features until the end of the period you already paid for, except where the store’s refund policy says otherwise.
Refunds
Refund eligibility depends on applicable law and the policy of the store that charged you:
- Apple App Store purchases: refunds are handled by Apple under Apple’s refund policy.
- Google Play purchases: see Google Play’s Refund Policy, or contact [email protected] for help with a refund request. Cancelling a Play subscription does not refund the current period except as that policy (or applicable law, such as a withdrawal right) provides.
Free Trial
If we offer a free trial, you will not be charged until the trial period ends. Cancel through the same store you used for the trial before it ends to avoid being charged.
7. User Content & Photo Uploads
The Service lets family members upload content, including profile avatars, reward images, optional photo proof of completed tasks (which may include images of children), and text such as task and reward names, descriptions, and notes. You are responsible for the content you upload and confirm you have the right to upload it.
Parental Consent
- By enabling photo features for your child, you consent to photo uploads
- You can disable photo requirements for any task at any time
- You can manage photos in the app or request help deleting stored copies at [email protected]; see our Privacy Policy for photo and account-deletion details
Content Standards & Reporting
Within Chorby, household content is available to authorized household members, not the public or other households. Service providers process data to operate the features described in our Privacy Policy. We have zero tolerance for objectionable content or abusive behavior. You agree not to upload content that is unlawful, inappropriate, or harassing, or that infringes the rights or privacy of others, and not to abuse or endanger any other user. Photos must relate to supported family features, such as task proof, profile avatars, or reward images. Parents are responsible for reviewing photos their children upload.
To report content or behavior that concerns you, contact [email protected]. We act on reports within 24 hours, removing violating content and, where warranted, terminating the responsible account. Unlawful content involving the exploitation of a minor will be reported to the appropriate authorities, including the National Center for Missing & Exploited Children, as required by law.
8. Virtual Currency (Gems)
Chorby uses a virtual currency system (gems) for gamification:
- Gems are earned by completing assigned tasks and, where enabled, through bonuses such as streaks, badges, or adventure progress
- Gems can be redeemed for family-defined rewards within the app
- Gems have no cash redemption value with Chorby
- Parents may offer gem-to-allowance rewards recorded in the app. Chorby does not transfer or pay that money; parents provide allowances and rewards outside the app
- Gems cannot be transferred outside the app
- Gems cannot be purchased with real money
- We reserve the right to modify gem values, earning rates, and rewards
- Gems may be forfeited upon account termination
9. Allowance Tracking
Important Disclaimer:
- Chorby provides allowance TRACKING only: it is an informational tool
- We do NOT process allowance payments between family members
- We do NOT connect your allowance records to banks or payment processors
- We do NOT transfer real money between accounts
- Parents are solely responsible for actually providing allowances to children
- Allowance records are for tracking purposes only and do not constitute financial advice
Chorby is not a financial institution and does not provide financial services or advice.
10. Intellectual Property
All content, features, and design elements in Chorby are the property of Chorby or our licensors and are protected by international copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, or create derivative works without permission
- You may not reverse engineer or attempt to extract the source code
- Our Chorby mascot characters, logos, and branding are proprietary
- You retain ownership of content you upload (photos, custom reward names, etc.)
- By uploading content, you grant us a license to use it to provide the Service
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- The results from using the Service will meet your specific requirements
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHORBY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
13. Termination
You may request account deletion through the app settings or by contacting [email protected]. If you own a household, a successful request closes that household on our servers and schedules its family data for permanent deletion after 30 days. During that period you may sign in to Start Fresh with a new household or contact support to request recovery of the old one. Starting Fresh keeps your login and new household; it does not restore the old household.
If you joined another person’s household and do not own one, Delete Account removes your account and membership immediately. The other household members and their shared family data remain. This immediate account removal does not have the household’s 30-day recovery window. After a successful request, the requesting device signs out; other devices apply closure when they reconnect, and copies already cached offline may remain visible until then. See our account-deletion instructions and Privacy Policy for the data covered and retention details. We do not send a separate email when the permanent purge completes.
Deleting your Chorby account does not cancel a subscription. Cancel in the store where you originally subscribed. For Apple App Store purchases, use iOS Settings → your name → Subscriptions. If you subscribed through Google Play, cancel in the Google Play app under Payments & subscriptions → Subscriptions, or at play.google.com/store/account/subscriptions. Apple or Google may keep billing you until you cancel there.
We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, illegal, or harmful activity
- Conduct harmful to other users or the Service
- Extended periods of inactivity
- At our sole discretion for any other reason
Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that should survive termination will remain in effect.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last updated" date at the top of this page
- Providing notice through the app or via email for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in Texas. You consent to the personal jurisdiction of such courts.
